Understanding Custody In North Carolina

Like in most states, decisions about child custody will rest with the judge unless both sides come to an acceptable custody agreement. The state tends to prefer joint custody, meaning both parents share legal and physical custody of the children. You and your ex will share decision-making authority over the child, and the child will split their living time between you.

However, if a joint custody situation is not necessarily possible or even wanted by one side, the court will look to the “best interests of the child” to finalize a custody plan. The state looks at these factors in the decision:

  • Health and safety of the child
  • The mental well-being of the child
  • Educational needs
  • Any parental history of drug abuse, alcohol abuse or violent behavior
  • The wishes of the child, provided the child is old enough

The judge weighs these factors with care and makes a determination on how to divide custody and visitation.
